TERMS AND CONDITIONS

1. In the event of any non-fulfilment of this Contract, the level of liability to the Engager or Artiste is limited to a maximum of the fee stated in this Contract. Contractual disputes must be notified in writing within seven days of the event.

2. Cancellations, amendments and postponements must be confirmed in writing. In the event of cancellations or postponements of the Artiste by the Engager, the deposit will not be refunded and in addition to this, cancellation fees shall apply based on the following:

- Where cancellation is made within 48 hours of confirmation no cancellation fee is due unless the event date is within the following 7 days, in which case 100% of the total remaining booking fee will be due to the Artiste.

- Where cancellation is made after 48 hours of confirmation but 365 days or more from the event the deposit will be non-refundable by the Artiste.

- Where cancellation occurs within 365 days and up to 91 days or more from the event 50% of the total remaining booking fee will be due to the Artiste.

- Where cancellation occurs within 90 days and up to 61 days of the event 75% of the total remaining booking fee will be due to the Artiste.

- Where cancellation occurs within 60 days of the event, 100% of the total remaining booking fee will be due to the Artiste.

3. Cancellation fees shall be paid to the Artiste within 7 days of the cancellation notice.

4. In the unlikely event of cancellation or non-appearance by the Artiste, any fees already paid to the Artiste will be refunded to the Engager in full within 7 days.

5. In the event of the Artiste being unable to fulfil this Contract due to illness or accident, the Artiste will undertake to provide where possible, and subject to availability, a replacement Artiste of a similar standard. Should the Engager be unsatisfied with the alternative Artiste being offered, the Engager shall receive a full refund of any payment(s) already made within 7 days.

6. Covid-19: In the event either party is unable to perform its obligations due to a ban on gatherings resulting from a pandemic/epidemic, such party shall not be liable for Cancellation Fees or damages to the other for any damages resulting from such failure to perform or otherwise from such causes. The deposit and any remaining balance up to the full amount paid to the Artiste by the Engager is refundable if rescheduling of the original booking is not possible.

7. Extensions to this Contract by way of additions and re-schedules involving increases in performance times and other labour charges are subject to additional fees to be agreed as amendments and confirmed in writing prior to execution.

8. General environment: The Artiste is to perform in a safe, non-abusive environment. Any mistreatment or abuse will result in the immediate discontinuation of services with deposit and full balance retained by the Artiste.

9. Use of Alternative or 'Dep' ('Deputy') Performers: The Artiste will utilise the standard line-up, as represented to the Engager, wherever possible. Should the need arise to substitute a performer due to unforeseen circumstances, the Artiste will have 'Dep' musicians/performers on stand-by to cover every eventuality. The Artiste reserves the right to use one or more 'Dep' performers if required in order to fulfil their contractual obligations. All 'Dep' performers utilised should have an equivalent level of ability and represent the Artiste in a similar manner to the promotional material portrayed to the Engager. The use of a 'Dep' performer does not constitute grounds for cancellation or a reduction in the fee. The Artiste must utilise a 'Dep' performer rather than cancel the booking.

10. Public Liability Insurance/Portable Appliance Test Certificates/Risk Assessment Statements.

The Artiste confirms that the equipment used and/or supplied is well maintained and covered by appropriate and prudent Public Liability Insurance and PAT certificates, The Engager has the right to request sight of the appropriate documentation to substantiate these assurances prior to use of the equipment, and it is the Engager's duty to satisfy itself in this regard if the equipment is for use by the public.

11. Food: The Artiste will not place excessive demands on the Engager regarding the provision of food. However, when the Artiste is required to perform at a function for an extensive period (e.g., Daytime Duo followed by evening performance), it would be greatly appreciated if some food can be provided. For evening performances, the Artiste would request that they can partake in the buffet where possible.

12. Communication: The Artiste is unable to meet up in person prior to the Engager’s event. All communication is via telephone and email.

13. If the Artiste is unable to set up or start performing at the agreed times as agreed for reasons beyond their control, they will not be obliged to extend the performance until a later time than agreed.
